This is the license that lets you install and use the QuakeMate iOS app. By downloading or using QuakeMate you agree to these terms. If you don't agree, please don't install the app.
Introduction
This End User License Agreement (“EULA”) is a legal agreement between you and Fil Technology (“we,” “us,” or “our”) for the QuakeMate mobile app (the “App”). The App is licensed, not sold, to you. See also our Terms of Service and Privacy Policy.
1. License grant
We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on Apple devices you own or control, as permitted by the Apple App Store Usage Rules, for your personal, non-commercial use.
2. Restrictions
You agree not to:
- Modify, copy or create derivative works based on the App.
- Reverse-engineer, decompile, disassemble, or otherwise attempt to derive source code, except where applicable law forbids that restriction.
- Remove, alter or obscure any proprietary notices in the App.
- Use the App for anything illegal, harmful or that would damage QuakeMate's reputation.
- Rent, lease, lend, sell, redistribute or sublicense the App.
3. Ownership
The App, its content, code, design and all related intellectual property are owned by Fil Technology and protected by copyright, trademark and other applicable laws. This EULA does not transfer ownership of anything to you.
4. Privacy & data
Using the App may involve collecting and processing personal data. How we handle that is described in our Privacy Policy. By using the App you agree to that policy.
5. Apple App Store terms
This EULA is between you and Fil Technology, not with Apple. Apple is not responsible for the App or its content. The license is limited to a non-transferable license to use the App on Apple-branded products you own or control, as set out by Apple's App Store Terms.
Apple and its subsidiaries are third-party beneficiaries of this EULA and may enforce it against you. To the maximum extent permitted by applicable law, Apple has no warranty obligation, no responsibility for addressing claims relating to the App, and no liability for product liability, intellectual property infringement claims, or compliance with consumer protection or similar legislation.
6. Updates
We may release updates that change, add or remove functionality. You agree that we're under no obligation to support, maintain, or continue any specific version of the App.
7. No warranty
The App is provided “as is” and “as available” without warranties of any kind. We don't warrant that the App will be error-free or uninterrupted, that earthquake data will be timely, accurate or complete, or that alerts will always be delivered.
8. Liability
To the maximum extent permitted by law, Fil Technology will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, data or goodwill arising from your use of, or inability to use, the App.
9. Termination
This EULA is effective until terminated. We may suspend or terminate it at any time for material breach. On termination you must stop using the App and delete it from your devices.
10. Governing law
This EULA is governed by the laws of Israel, without regard to its conflict-of-law rules. You agree to submit to the exclusive jurisdiction of the courts of Tel Aviv-Yafo for any dispute arising from this EULA, subject to any mandatory consumer-protection rights in your country.
